Ellis & Co. has provided market-leading expertise in intellectual property law from its inception in Zambia to date. The steady stream of instructions and level of efficiency required by our clients has necessitated the creation of a department specialised in this area.
The Intellectual Property Department carries out instructions for searches, filing, prosecution, registration and renewal of IP rights relating to trademarks, patents, copyright and industrial designs. We also routinely provide advisory, drafting and contract review services to clients in respect of transactions involving their IP rights.
Further, in conjunction with the Litigation & ADR Department of the firm, the IP Department represents clients in opposition and expunction/cancellation proceedings, as well as infringement, malicious falsehood, confidential information, anti-counterfeiting and ‘passing off’ suits, often resulting in amicable settlement or favourable outcomes before courts of the highest authority.

The drafting of contracts, preparation and execution of wills, administration of estates of deceased family members, registration and maintenance of businesses, as well as the buying, selling and mortgaging of property, are best achieved with the assistance of a lawyer.
The Conveyancing and Corporate Department is committed to the furtherance of your goals and your peace of mind. We regularly prepare, review and provide counsel regarding:
- contracts, partnership and joint venture agreements, and assignments
- mortgages and lease agreements
- wills and administration of estates
- constitutions and articles of association
- trust deeds
and other documentation aimed at securing and furthering the personal and business interests of our clients. In addition, we act in the obtention of immigration and other permits, as well as Certificates of Title. We also provide commissioning and notarial services.

The Litigation & Alternative Dispute Resolution team consists of battle- tested litigators who represent clients in the subordinate (magistrates) courts, all divisions of the High Court, the Court of Appeal, the Constitutional Court, and the Supreme Court of Zambia. We also act for clients in proceedings before tribunals and commissions of inquiry, as well as arbitrations and mediations.
The range of matters we deal with includes criminal matters, land, family and contractual disputes, personal injury claims, employment disputes, actions against public bodies in their exercise of statutory powers, constitutional law and election law.
While litigation is the cornerstone of our practice and the traditional way of resolving disputes, we recognise that the quickest and most cost-effective route to settling a dispute may not be through the court process, but Alternative Dispute Resolution (ADR). In this regard, we advise, and represent clients, in negotiation, mediation and arbitration.
The breadth and depth of our accumulated knowledge and practice in the resolution of disputes is on record. We have a proven track record of facilitating negotiations that resolve conflicts or avert criminal proceedings while preserving the dignity of the parties, safeguarding privacy and confidentiality, and maintaining business and family relationships. We also routinely support clients through mediation proceedings. Further, we have handled a plethora of high-stakes arbitration proceedings, notably in employment and construction law, on behalf of local and international clients.
